Terms and Conditions (AGB)
§ 1 General
The JORDAN, Teufelseestrasse 41, 65428 Rüsselsheim, Germany, info@jordan-collection.com, operates an online shop
at the website www.jordan-collection.com (hereinafter referred to as the “Website”). The offers are addressed exclusively to consumers who purchase goods for private purposes.
For all orders placed via the Website and for our deliveries and services, only the following General Terms and Conditions shall apply in the version valid at the time of the order. Deviating provisions of the customer shall not be recognized unless we have expressly agreed to their validity in writing.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 2 Conclusion of Contract
1. The languages available for concluding the contract are German and English.
2. The presentation of goods on our Website does not constitute an offer by jordan-collection.com to conclude a purchase contract.
3. By submitting the order form provided on our Website, you make a binding offer to conclude a purchase contract with us and at the same time declare that you are acting exclusively for private purposes.
You submit the offer by entering all required information during the ordering process and finally sending the order form to us by clicking the button “Place order”. Before submitting the offer, you will receive an overview of the information you have provided and the opportunity to correct any input errors.
4. After receipt of your order, we will send you an email confirming receipt of your order and listing the details of your order (order confirmation). Please note that this order confirmation does not constitute acceptance of your contractual offer, but merely serves as information.
5. The purchase contract between you and jordan-collection.com is only concluded when we accept the offer by dispatching the ordered goods. In the case of advance payment, dispatch will only take place after the full amount has been credited to our account.
6. jordan-collection.com is entitled to reject an offer from you without stating reasons, in particular if there is justified suspicion that the goods purchased via the internet are intended for commercial resale.
7. jordan-collection.com reserves the right to reject or cancel an order if it was generated by software, machines, crawlers, spiders, other automated web programs, scripted behavior systems, or by using third-party services acting on your behalf.
§ 3 Right of Withdrawal
The right of withdrawal applies exclusively to consumers pursuant to Section 13 of the German Civil Code (BGB).
RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the last goods.
To exercise your right of withdrawal, you must inform us, Jordan, Teufelseestr. 41, 65428 Rüsselsheim, Germany, info@jordan-collection.com , by means of a clear statement (e.g. by email) of your decision to withdraw from this contract.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
CONSEQUENCES OF WITHDRAWAL
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract.
We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.
We may withhold the reimbursement until we have received the goods back.
You must return or hand over the goods to us without delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.
You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
EXCLUSION OR EXPIRATION OF THE RIGHT OF WITHDRAWAL
The right of withdrawal applies only to items that have not been individualized or altered. The right of withdrawal expires for personalized products.

§ 4 Voluntary Right of Return
1. Independently of your statutory right of withdrawal, jordan-collection.com grants you the following voluntary right of return: All products purchased from jordan-collection.com may be returned within 14 days of receipt of the goods.
The right of return applies only to unworn, unwashed, and flawless items with all labels still attached. Any loss in value caused by wearing, washing, or other signs of use—such as perfume or body odors, traces of cosmetics or lipstick, stains of any kind, damage to the fabric, or removal/damage of the original packaging, accessories, or similar items—will result in rejection of the return, as such items cannot be resold. In this case, the goods will be returned to the customer without a refund of the purchase price.
2. Returns
2.1 The customer bears the cost of return shipping, provided the following provisions are complied with.
2.2 The method of return shipment may be freely chosen by the customer.
2.3 In the event of a return, a credit will be issued to your account/card; any losses due to currency fluctuations will not be reimbursed.

2.5 Please note that orders for personalized products cannot be canceled and that products which have been personalized in any way or manufactured according to your individual specifications cannot be exchanged or refunded. This includes, among other things, custom-made items, special orders, and products that have been engraved or altered from their original condition (size adjustments, modifications).
3. We reserve the right to regularly review the purchasing and return behavior of our customers. If a return rate exceeding seventy percent (70%) is identified within a period of up to twelve (12) months, we are entitled, at our reasonable discretion, to temporarily or permanently refuse or block future orders. This measure serves in particular to avoid excessive environmental impact caused by unnecessary transport routes and packaging materials and to improve product availability and quality. All statutory rights of customers, in particular the right of withdrawal and warranty claims, remain unaffected. The exercise of these statutory rights is neither restricted nor excluded by the above regulation.

This voluntary right of return does not limit your statutory rights and therefore does not affect your right of withdrawal described above.
§ 5 Prices, Product Presentation, Availability
5.1 The prices stated on our website www.jordan-collection.com at the time of your order shall apply.
5.2 The goods offered on jordan-collection.com are presented on the Website in the form of digital photographs of the actual existing goods. Minor deviations between presentation and reality do not constitute a defect of the ordered goods.
5.3 If you order several products at the same time, individual products may be delivered at different times. Section 266 BGB remains unaffected. Shipping costs will only be charged once.
§ 6 Storage of the Contract Text
We store your order data. If you wish to print your order, you may print the “order confirmation” displayed on your screen after submitting your order by clicking the “Place order” button and after your credit card details have been successfully verified. You will also receive the order confirmation with all details by email.
§ 7 Delivery & Shipping
7.1 Shipping is carried out via DHL. The transport risk is borne by jordan-collection.com.
7.2 The goods will be ready for shipment within 3 days of your order, excluding made-to-measure items or goods altered according to your request. Unless otherwise agreed, delivery will take place within 1 to 5 business days to the delivery address specified by the customer, depending on the shipping method and destination. In the case of advance payment, delivery will only take place after the full purchase price has been credited to our account.

Germany (standard): EUR 6.00
EU countries: EUR 17.00
For partial shipments, shipping costs are charged only once.
§ 8 Payment, Default, Set-Off, Right of Retention
8.1 Accepted payment methods:
You can pay for your order at jordan-collection.com via:

– Stripe (various credit cards)

All payments and refunds are processed in the currency of the purchase.
8.2 Set-off
Set-off by the customer is excluded unless the counterclaim has been legally established, is ready for decision, undisputed, or relates to a claim for reimbursement of defect rectification costs arising from the same contractual relationship.
8.3 Right of retention in commercial transactions
In commercial transactions, the buyer’s right of retention and right to refuse performance are excluded, except for undisputed or legally established counterclaims or claims arising from defect rectification under the same contract.
§ 9 Retention of Title
The delivered goods remain the property of jordan-collection.com until full payment has been made.

§ 11 Warranty
Claims for defects in the delivered goods are governed by statutory provisions, with the exception that claims for damages due to defects exist only in accordance with § 12 below.
§ 12 Liability
12.1 We are liable without limitation for intent and gross negligence. In the event of a slightly negligent breach of a primary obligation or a secondary obligation whose breach jeopardizes the purpose of the contract or whose fulfillment enables proper performance of the contract and on whose compliance the customer may rely (“essential obligation”), our liability is limited to foreseeable damages typical for the contract. We are not liable for the slightly negligent breach of non-essential contractual obligations.
12.2 Liability for fraudulent concealment of defects, assumption of a guarantee of quality, claims under the Product Liability Act, and damages resulting from injury to life, body, or health remain unaffected. This does not entail a change in the burden of proof to the detriment of the customer.
13.3 To the extent that liability of jordan-collection.com is excluded or limited, this also applies to the personal liability of employees, staff, representatives, and vicarious agents.
§ 13 Choice of Law, Validity
13.1 All legal disputes arising from or in connection with the purchase contract shall be governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13.2 Should one or more provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
